Event Description
The Employment Standards Act sets the rules for employment practices in your office and in the field. Your current work rules may fall short of your statutory obligations even though they are well accepted by your staff. You usually find out you are not in compliance too late and are faced with months of back pay owed.
This two-hour seminar will give you a review of Employment Standards Act requirements that are particularly relevant to construction industry employers, including: 
  • Employment contracts
  • Who is a "manager"
  • Hours of work and overtime
  • Averaging agreements for hours of work
  • Termination of employment
  • Vacation and statutory holidays
  • Independent contractors vs. employees
  • Impact of the common law
Presenter: Marcia McNeil, LL.B. 
Marcia McNeil has practiced in the areas of labour, employment and human rights law since 1990 and represents employers in the private and public sectors.
Marcia has been recognized consistently since 2012 in the Canadian Legal Lexpert Directory in the area of employment law. She was the Chair of the B.C. Industry Training Appeal Board and the Vice-Chair of the Community Care and Assisted Living Appeal Board of British Columbia. In 2013, she was a sessional lecturer in Employment Law at the University of Victoria.
Marcia began practicing in Vancouver after clerking with the British Columbia Court of Appeal. She subsequently became a senior counsel at the B.C. Labour Relations Board and later transferred to a position with the then Public Service Employee Relations Commission providing advocacy and bargaining services to the Government of British Columbia.
In 1998, she joined the Victoria-based labour and employment firm Fuller, Pearlman, McNeil before joining a national law firm in 2008. Together with Peter Sheen and Susan Arnold she founded Sheen Arnold McNeil in 2013 and continued her practice with that firm until its lawyers joined with Pulver Crawford Munroe in 2018.

Refund Policy



Cancellations received at least 10 business days prior to the course will result in a full refund.


Cancellations received less than 10 business days but more than 5 full business days prior to the course are subject to an administration fee of $100 per day for full and half-day seminars, or $25 for breakfast sessions.


Registrants who do not show up for a course, and/or who do not notify CITN at least 5 full business days prior to the course date will be assessed the full cost of the course. There will be no refunds or credits in this case.


Substitution of attendees is permitted up to and including the day of the course.




CITN may have to postpone or cancel courses due to insufficient enrolment, in which case CITN’s liability will be limited to a refund of the registration fee.
