Event Description

 

Set up in 4 - 1/2-day live instructor led online training sessions (8:30am – 12:30pm each day) this seminar will cover the same content as the in-person seminar. There is no opportunity to re-schedule or request for a partial refund if a student cannot attend all sessions. Please plan to be fully engaged in the class and clear your work schedule just as you would for the in-class program.

 

Participants will develop an understanding of contract law as it relates to construction and the various CCDC/CCA and other contracts used within the industry. Participants will also learn how the BC Builders Lien Act works and the other legal means to resolve construction disputes and avoid litigation. At the end of the course participants will be able to:

  • Understand the basics of contract law –intention, offer, acceptance, consideration, capacity and legality
  • Be familiar with various CCDC/CCA contracts -how and why they are used
  • Be familiar with various legal terms used in contracts
  • Understand the contract responsibilities of various parties
  • Understand the bidding process and contractual obligations
  • Define back charges and how to avoid them
  • Avoid construction disputes and claims from the site level
  • Write RFIs and Change Orders 
  • Understand the dispute resolution process – negotiation, mediation, arbitration, and litigation
  • Use the Builder’s Lien Act to obtain security
  • Use the small claims process to collect debts
  • Understand environmental law and how it impacts projects
  • Understand safety law and it impacts construction companies
  • Understand how specifications and drawings fit within the contractual hierarchy
  • Understand the contractual relationship between contractor and sub-contractor 
  • Compile and submit proper extras and claims

  • Bidding process and contractual obligations

Four days (16 hours) of virtual lessons with instructors plus an online portion involving research, reading, and answering questions (7-8 hours) that will be marked by the instructors. 

 

To receive a 5 Gold Seal accredited certificate, you must complete the online portion after the 4 virtual classroom sessions.

 

Instructors

 

Tim Williams MBA, B.Econ., CPA, GSC, is the President of BGC Partners Inc. Tim has worked with numerous construction companies for over twenty years. He is a Gold Seal Certified project manager. He is an experienced and sought-after trainer who has trained construction owners and managers on behalf of construction industry associations across Western Canada.

 

David Letkemann BBA, LLB, is a partner at Linley Welwood. David practices in the field of civil litigation, including personal injury, commercial, estate and construction law. He is an experienced litigator having participated in numerous trials in the BC Supreme Court and has also appeared before the Court of Appeal on several occasions.

TECHNICAL REQUIREMENTS:

    • This course will involve on-screen interaction with your instructor and classmates, reading/viewing on-screen content (slides or videos), and interacting via typing with questions or responses. For this reason, cell-phones or tablets may not be adequate.

  2. Webcam – in order to engage and collaborate, participants will be expected to have their webcams on for the duration of the class
  3. Microphone
  4. Internet connection - For best results, you will want to ensure you have an internet connection with an upload/download speed of 3-5 Mbps. You can test your internet speed here. Minimum recommended speed is 1.5 Mbps, but anything below 3 Mbps may result in loss of quality or buffering. Ideally hardwired connection versus wireless for stability - connect your computer directly to your router using an ethernet cable, rather than using your home wi-fi.
  5. A quiet space with minimal distractions - microphone will be engaged for interactive sessions. Please plan to be fully engaged in the class and clear your work schedule just as you would for the in-class program.

Cancellation &
Refund Policy

COURSE REGISTRATION CANCELLATIONS, TRANSFERS & REFUNDS:

 

Cancellations received at least 5 business days prior to the webinar date will result in a full refund.

 

Registrants who do not attend/log into a webinar, and/or who do not notify CITN of cancellation at least 5 full business days prior to the course date will be assessed the full cost of the webinar. There will be no refunds, transfers or credits in this case.

 

Substitution of attendees is permitted up to and including the day of the webinar.

 

COURSE CANCELLATION BY CITN:

 

CITN may have to postpone or cancel webinars due to insufficient enrolment, in which case CITN’s liability will be limited to a refund of the registration fee.
